NASA, Unitech case today

AN URGENT application in the pending court case between the National Academic Staff Association (NASA) and Unitech was heard yesterday by Justice Nemo Yalo, in his first appearance as acting National Court judge.
A notice of motion filed on Jan 15 was submitted before Justice Yalo by Unitech counsel George Epor seeking to discharge the Dec 20 order by late judge Justice Moses Jalina.
The order restrained Unitech from terminating and evicting NASA members and was made returnable by the late judge Justice Jalina last Dec 20.
The matter was postponed to next Friday.
In his submission before Justice Yalo, Mr Epor pointed out that the matter was urgent, and the restraining orders would adversely affect the academic year if they had to wait until a decision was made on Feb 8.
Mr Epor said NASA, as a separate entity, had no standing to take court actions on behalf of its members and that they had to go about it as individuals.
NASA’s counsel Rakatani Raka sought an adjournment as he had not received instruction from his client after numerous attempts to contact them.
He said it was believed that some NASA members were locked out of their offices, which was why they could not be reached.
Justice Yalo adjourned the matter giving time for NASA’s counsel to get further instructions from his client.
The case will be heard before the same judge today.
