Case between PM and members of inquiry adjourned

THE National Court hearing the case between Prime Minister Sir Michael Somare and the members of the PNG Defence Force Board of Inquiry to the Moti escape into the Solomon Islands last October was adjourned to next Tuesday for directional hearing.
The adjournment was made following an undertaking given by the plaintiff’s lawyer Kerenga Kua of Posman Kua Aisi Lawyers to the court that they would not be moving their application OS No.104 of 2007 filed on Feb 26 seeking to nullify the inquiry’s existence.
Presiding judge Deputy Chief Justice Sir Salamo Injia ruled for the new date for a directions hearing after it was brought to the plaintiff’s lawyer’s attention that a letter signed by Sir Michael effecting 10 working days extension for the defendants (Board members) to complete its final findings of the inquiry.
The extension was until March 15.
The letter signed by Sir Michael was produced by the defendants’ lawyer Turai Elemi of Elemi Lawyers.
The directions hearing will involve both parties establishing to the courts the stages of each of their proceedings.
