Court stops eviction of Gordon flat residents
THE National Court has restrained the National housing corp (NHC), Money Talks Ltd and businessman Mathew Minape from selling the Gordon flats or evicting the residents.
Deputy Chief Justice Salamo Injia issued this order last Friday in Waigani.
The order was issued on behalf of chairman of Gordons flats working committee George Kakas and 63 others, who face being evicted following the alleged sale of the flats to Money Talks.
Mr Kakas and his group are fighting the sale, alleging it was illegal and that the NHC had breached an earlier undertaking not to sell the flats.
They alleged the sale of allotment 30 section 97 as null and void and that the title transfer and registration was done fraudulently.
They are seeking an order that the Registrar of Titles revoke the title transfer from NHC to Money Talks owned by Minape.
The case comes before Sir Salamo for a full hearing on March 17.
In the interim, Money Talks, Minape and NHC, who are defendants in the proceedings, are barred from evicting the tenants or interfering with the enjoyment of the property by the tenants.
Mr Kakas said the tenants intend to pursue the case vigorously and expose the corruption and illegality behind the deal.
The file on the property at the Lands Department is missing and could not be produced in court.
The NHC lawyer appeared in court without any documents and could not produce any file relating to the property.
Meanwhile, it is understood Housing Minister Andrew Kumbakor had provided a brief to the Prime Minister on the NHC situation and is preparing a National Executive Council (NEC) submission to suspend managing director Paul Asakusa.
But Mr Asakusa was aware of the move and had written to the NEC advising against a suspension.
