Powi’s court order set aside

THE restraining order obtained by acting Southern Highlands provincial administrator William Powi has been set aside by the National Court.
Mr Powi had taken out the orders to prevent provincial executive council appointee Alphonse Haiyabe from taking office.
Mr Haiyabe was appointed by the provincial executive council during its meeting in Mendi last month after the Supreme Court ruled that the state of emergency (SoE) and the suspension of the provincial government were null and void.
Paul Mawa of Mawa lawyers went to court last Thursday to petition that the restraining orders sought by Mr Powi be set aside.
The court granted the petition.
Lawyers from both sides agreed to set aside the order because another matter between Mr Powi and Mr Haiyabe over the position of administrator was pending before the National Court.
The PEC, in its meeting last Tuesday at the Gateway Hotel, decided to withdraw its decision to appoint Mr Haiyabe because the PEC in September last year had already appointed Mr Haiyabe.
It was agreed that there was no more need for PEC to make another appointment.
Mr Haiyabe’s September appointment was now a matter before the National Courts.
Governor Hami Yawari said on Thursday the National Executive Council made the decision last September making the second appointment unnecessary.
