Telikom, ICCC lawyers told to be fully prepared

LAWYERS for Telikom PNG and ICCC, who are before the National Court to determine whether or not ICCC has fulfilled the three conditions put forward by Telikom to the ICCC in bringing forward the cessation of its monopoly period in the telephone industry in PNG, were yesterday told to return for a hearing next Monday fully prepared.
Justice Ambeng Kandakasi had ordered the lawyers on Tuesday to come back yesterday with intentions to proceed with a hearing, but this did not eventuate. They had not completed finalising their out-of-court negotiations before showing up.
The judge adjourned the matter and asked the two lawyers – Ian Shephard of Blake Dawson Waldron for Telikom and Erik Andersen of Gadens Lawyer for ICCC – to fine tune their stands in relation to their submissions before their appearance.
The current National Court proceedings between Telikom PNG and ICCC is to determine whether or not ICCC has fulfilled the three conditions put forward by Telikom to ICCC in bringing forward the cessation of its monopoly period in the telephone industry in PNG.
ICCC was seeking an agreement early last year from Telikom to bring forward its deadline of the regulatory contract of Telikom’s telephone monopoly, which was supposed to expire on Oct 17, to last April 1.
In a letter dated last Feb 20 by then acting managing director Noel Mobiha to Thomas Abe, commissioner and chief executive officer of ICCC, Mr Mobiha agreed to the issue on three conditions.
That:
*Telikom is supplied in advance with the full details of the terms, conditions and regulations to be supplied to the proposed competitors;
*Telikom is assured that it will be subject to fair and reasonable competition and not subject to a situation where we must provide services in uneconomical areas, at the expense of competitors who are not obliged to do so; and
*Telikom and its competitors will be required to meet similar technical standards and safety requirements.
