Lack of evidence forces court to set mum free

A 50-YEAR-OLD mother who allegedly aided her husband in sexually abusing her daughter 12 years ago was dismissed of sexual penetration charges and freed by the district court in Lae due to lack of sufficient evidence to commit her to stand trial yesterday morning.
Agatha Damien, 50, from Aibom village, East Sepik province, appeared before Committal Court magistrate Posain Poloh, who ruled that the medical evidence by Dr Manah Ario of the Angau Memorial General Hospital could not support the charge of sexual penetration.
Mr Poloh told the court that the medical evidence only pointed to injuries on the outer parts of the victim’s body and subsequent mental trauma and stress related to abuse by the father.
He said the medical evidence only cited abuse by the father and did not mention the mother.
