Powi seeks appeal against termination

WILLIAM Powi is seeking an appeal against a igh court judge’s recent orders in which the National Court upheld his termination.
He is also seeking to stay Justice Ambeng Kandakasi’s court orders made on April 10 and 12.
The National Court in Mt Hagen upheld Mr Powi’s termination on April 10, shortly after the National Executive Council sent him back to Southern Highlands province as the administrator.
The urgent application filed on Monday at the Waigani National Court came before acting Chief Justice Sir Salamo Injia yesterday.
Mr Powi’s lawyer, Kelly Naru, made an application seeking the Supreme Court’s appeal of Justice Kandakasi’s orders made recently and also to stay the orders issued by the judge.
Mr Naru sought for interim orders to be granted pending the hearing of the stay application.
However, Sir Salamo said interim orders issued by Justice Kandakasi would remain until the returning of the matter in Mount Hagen.
The judge was not in position to fully hear the parties’ arguments and and adjourned to today for hearing.
Sir Salamo said the interim orders issued by the National Court should be stayed until the matter was properly argued. He said further proceedings in Mount Hagen should also be stayed until the Mr Powi’s application is heard and determined.
The court ordered that the interim orders by Justice Kandakasi be returned today and will remain in force until the application for stay is heard and determined.
