POLICE have not acted upon a warrant for the detention of Port Moresby
Northeast MP Casper Wollom who has been alleged to have failed to repay
a K47,000 debt, the National Court heard yesterday.
The warrant was signed by Justice Ambeng Kandakasi.
However, the court cannot force the police to execute the warrant as the
court had already done its job by signing it, National Court judge
Justice Catherine Davani said yesterday.
She said this when the counsel for the couple suing Mr Wollom told the
court that no action had been taken by the police as yet over the
warrant.
They also said the police were well aware of such a warrant but unsure
whether to use it as the hearing into the stay of warrant remained
pending.
Justice Davani also said the warrant upon being served was to be
executed within seven days if non-compliance was made by Mr Wollom.
The one-page warrant of commitment dated May 30 against Mr Wollom was
served to superintendent operations John Anawe last Wednesday, but has
not been executed.
Wagambie lawyers acting for Mr Wollom, in a special fixture case at the
National Court in Waigani yesterday, told the court that he (counsel)
did not have any knowledge of a warrant signed by Justice Kandakasi on
June 30, 2007, as they were never served a copy.
However, Justice Davani yesterday informed Wagambie Lawyers that there
was a signed copy of the warrant in the court files before her and as
such, she could not hear submissions on the notice of motion for staying
the warrant until counsel had seen the copy.
