Court upholds ruling
 


THE National court yesterday upheld its decision of last Friday and ordered returning officer Nickson Kupe of Tambul Nebliyer electorate to count the only disputed ballot box immediately.
Justice Panuel Mogish ordered Mr Kupe to count the marked ballot papers in box number 43 with the sequence numbers 07380 to 08412 and tag number 73760.
The judge also ordered the security personnel to refrain from interfering with the powers and function of the returning officer, provincial election manager and the presiding officers.
Justice Mogish also penalised Mr Kupe for professional negligence when setting aside the disputed box and ordered him to pay the plaintiff Philemon Wass Korowi’s cost of the proceedings.
Counting of votes for the electorate resumed yesterday after five days of delay.
