Court dismisses self-defence claim, finds man guilty


A GOROKA man was found guilty of wilful murder at Waigani National Court yesterday.
The court heard that Onama Andrew allegedly killed Eganda Kane, 21, at Gerehu Stage 4 in May last year.
The case was heard on Tuesday and submissions were made on Wednesday before the National Court judge Justice Panuel Mogish. The sentence will be decided today.
“I am satisfied beyond reasonable doubt that the accused in the company of Michael Grass and others wilfully murdered the deceased. He is guilty of wilful murder,” Justice Mogish said.
The court heard that in his statement to the police when he was first arrested he stated that he “acted in self-defence.”
The judge pointed out that if the accused had acted in self-defence, then why were there more than 19 stabbed wounds noted by Dr Golpak on the body of the deceased.
“The multiplicity of the stabbed wounds, in my view, negates the defence of self-defence claim.
“The wounds on his chest, being the most vulnerable part of his body, and the use of lethal weapons like bush knives, demonstrate their intention to kill the deceased,” Justice Mogish ruled.
“I do not accept the statement that he acted in self-defence. Nor do I accept his evidence that they were not involved. I do not find these credible,” he added.
