Dusava plans to call up 37 witnesses against Wararu


PETITIONER Gabriel Dusava plans to call 37 witnesses to testify in the petition challenging the win of Peter Wararu in Yangoru Saussia in East Sepik province.
Mr Dusava is alleging bribery and errors and omissions by the election officials in his attempt to annul Mr Wararu’s victory.
During a hearing before Justice Mark Sevua last Thursday, Mr Wararu’s lawyer questioned whether lawyer Patrick Harricknen should continue to represent Mr Dusava as he (Mr Harricknen) also contested the elections.
Justice Sevua said he would review the situation and make his ruling on whether Mr Harricknen should continue as Mr Dusava’s lawyer, but urged Mr Harricknen and his client to discuss the matter and reach a compromise by Oct 18, the date for the next pre-trial hearing.
Mr Harricknen submitted he would call on the Electoral Commission for the returns for the ballot papers for the whole electorate and for the tally books and tally forms to be withheld in a safe place pending the outcome of the petition.
Mr Harricknen also submitted that his client would seek orders from the court to ensure that the sitting MP does not have access to electoral funds, pending the outcome of the petition before the court.
Mr Wararu’s lawyer said they would call 18 witnesses to fight the case.
