Telikom appeal decision pending

THE Supreme Court is expected to make a decision before the year is out on the appeal by Telikom over the dismissal of its proceedings at the National Court in July this year.
Telikom is appealing that decision and seeks to overturn that decision as it contends that issues arising in those proceedings were not properly dealt with.
The issue relates to a variation of a contract between Telikom and the Independent Consumers and Competition Commission (ICCC) in February last year to bring forward the end of Telikom’s mobile monopoly from Oct 17.
Telikom said that ICCC did not meet three other conditions in that contract made by Telikom and therefore there was a breach.
Digicel and ICCC argued that Telikom already agreed to the contract and that an appeals panel set up under the Telecommunications Act to review ICCC’s decisions to issue mobile licences to Digicel and another mobile company confirmed that there was no breach.
Deputy Chief Justice Salamo Injia and his assisting judges Justice Nicholas Kirriwom and Justice David Cannings are reserving their ruling on this to a later date.
