Firms must file returns


ANY company in the country failing to file annual returns can be removed from the register, Registrar of Companies Alex Tongayu says.
Tongayu said that when he revealed that one such company, Koitaki Plantations Ltd, had failed to lodge its returns for the past eight years, from 2008 to 2015.
In a paid advertisement recently, Tongayu gave notice to remove the company from the registered companies on Oct 4 pursuant to section 365 of the Companies Act 1997.
According to the notice, the grounds for the removal of this company, was failure to lodge annual returns for eight years.
In addition, the directors of the company, as individual directors and collectively as a board, failed to comply with mandatory provisions of various sections of the Companies Act 1997 in the last eight years.
