5 parties given ok to intervene

FIVE interested parties have been granted leave to intervene in a Supreme Court application filed by Opposition Leader Belden questioning the constitutionality of Prime Minister James Marape’s election in May last year.
The interested parties are Marape, Minister for Justice and Attorney-General Davis Steven, Speaker of Parliament Job Pomat, the Registrar of Political Parties Alphones Gelu and Pangu Pati.
However, Marape’s lawyer, McRonald Nale, yesterday during the court session, raised a serious issue regarding Namah’s capacity as the Opposition leader when Justice David Cannings sought any opposing response from interveners regarding the application.
Nale contended that Namah, despite having filed a new amended application, still did not have the capacity to pursue the matter due to the fact that he (Namah) was found guilty by a leadership tribunal in 2018 of improper conduct and abuse of power.
Nale said the leadership tribunal found Namah guilty of misconduct in office and recommended that he be dismissed from office as Member for the Vanimo-Green River electorate.
This all came about when Namah sought a stay order, pending a judicial review over the tribunal’s decision.
Nale argued that Namah should not be pursing the matter as he had been recommended for suspension by the leadership tribunal.
“There is a case that still needs to be answered before Namah can proceed or claim that he is the leader of opposition,” Nale said.
Nale based his stance on the Organic Law on Duty and Responsibility of Leadership, under section 27 where an individual had been referred to a tribunal for alleged misconduct in office and was suspended from duty.
The matter which Nale was referring to was on May 24, 2012, where Namah, in the company of other policemen and soldiers, went into a court room former Chief Justice Sir Salamo Injia was presiding over interrupted the session when he shouted in a threatening manner and demanded Sir Salamo’s immediate resignation and arrest.
Nale asked where the recommendations of the leadership tribunal stood today.
Justice Cannings told the court that these where matters to be raised in regards to Namah’s standing. The matter was adjourned to May 1 for a directions hearing with interveners.

  • Give a chance to PMJM. This is not Opposition. It is something different. If it was opposition, he will surely give space to leadership of PMJM to through this period to election 2022. Its emergency period, an unforseen circumstance. Your experience of the Bougainville crisis was different. You saw it coming and you were there for it. This emergency?, no one saw it coming. It took the country by surprise. This government is doing what it do from what it can mobilize. Give the leadership a chance and stop this and support the government.

  • Hope all the expenses were paid from their own pockets and not from tax payers money. What good shall this battle bring to the people of this country? Talk about life saving issues for the people and the tax payers of this country on how best to protect and provide for them at this time of peril rather than for your own gain. He is the country’s opposition leader and every action must not be a breach of constitution. Just leave him alone so that he still can make noise on the other side of the house. If a person is desperate to be the next prime minister good wait until 2022 and not now; not yet.
