Another delay in Vaki’s case

A Supreme Court hearing of former Police Commissioner Geoffrey Vaki’s appeal against his contempt of court conviction has been delayed because two National Fraud and Anti-Corruption Directorate heads had no legal representation.
The hearing by Justice Terence Higgins yesterday was only attended by Vaki’s lawyer Greg Shepherd.
The respondents, Matthew Damaru and Timothy Gitua, were not present or represented by a lawyer.
Shepherd said it was not surprising to see the respondents not in court for the hearing.
He said the Supreme Court ruling on Wednesday had restrained any law firms from representing the respondents in court without approval from the Attorney-General.
He asked for an adjournment of the hearing until the respondents got an approval for their legal representation.
The hearing was adjourned to March 7.
The court had issued an interim order restraining Damaru and Gitua from having any legal representation in court because as police officers and state servants dealing with matters arising out of their service and duties of their employment, they needed approval by the Attorney General for their legal representation.
The court further ordered that Jema Lawyers, that had been representing them, or any other law firm that would represent them, seek approval from the Attorney General.
