THE Supreme Court has rejected two separate leave applications by Usino-Bundi MP Anton Yagama and the Electoral Commission to review a National Court’s decision ordering the recount of ballot papers.

It means the re-counting of the Usino-Bundi open electorate seat in Madang will proceed.

Justice Ellenas Batari refused the two applications for review in the Supreme Court on Monday.

Yagama and the commission had filed two separate leave applications in the Supreme Court this week to review the National Court’s decision to order a recount of votes for the seat.

The matter was scheduled for the hearing of the stay application by the sitting MP yesterday in the Supreme Court before Deputy Chief Justice Gibbs Salika and Justices Joseph Yagi and Goodwin Poole.

But the lawyers advised the court that the two leave applications had been refused.

Salika said because of that, there was no substantive matter to deal with.
