A WOMAN was found guilty of one count of conspiracy to defraud and a count of misappropriation on Friday by Justice Panuel Mogish at the National Court.
Justice Mogish found Kila Veropo guilty of defrauding Anna Sani of 781.2g of gold worth K105,340.50 and used the money in 2015.
“In this case, evidence of dishonesty arises by implication on my finding of dishonesty and deceit on the issue of conspiracy to defraud,” Justice Mogish said.
“I am satisfied that Veropo was acting dishonestly because I can see why a woman of her intelligence and business experience would not have appreciated as right-minded people would have done, that what she was doing was dishonest.
“The State has established the guilt of the accused beyond a reasonable doubt.
“I have no hesitation in convicting her of the charge of misappropriation,” he said.
The court heard that between Oct 27, 2015 and Oct 29, 2015 Sani arranged with one Phillip Drang to sell 903.6g of gold where they met with others (Ernie Choi, Henry Mathias, and Joseph Wai, Veropo’s husband), who were commodity agents for ABC Refinery Inventory and entered into an agreement with Veropo Commodity Agency owned by Kila Veropo.
They agreed that Sani would be paid K105,340.50 and opened an ANZ Bank account as she was told that her payment would be made into that account.
The agreement was signed by representatives of Veropo Commodity Agency and Kila Veropo.
Sani gave the gold to Veropo’s husband after believing what she was told but she never received any payment as promised.
She found out that the money was not paid into Veropo Commodity Agency account but to another account belonging to Veropo.
She laid complaint with Downtown police and Wai and Veropo were arrested.
The matter was adjourned.
