THE National Court in Waigani has issued a stay order on an earlier order sought by Central New Hanover Ltd.
It is to prevent Tutuman Development Ltd and Joinland (PNG) Ltd from operating under it within Portion 887C in Kavieng.
Portion 887C is utilised for special agriculture business lease purposes.
Yesterday’s court order stayed the order issued on Nov 18 obtained exparte by Central New Hanover Ltd.
The stay will remain until the parties appear for the substantive hearing at Kokopo National Court next Friday.
The stay order was sought yesterday by the defendants’ lawyer on the ground that the court order of Nov 18 stemmed from a court proceeding pursued by the former secretary of CNH Ltd.
The court was told that the individual was no longer working with CNH Ltd and that the order of Nov 18 was not necessary.
Justice Salatiel Lenalia then ordered the order to be stayed.
The court was also told that the plaintiff company owned the lease, and the first defendant Tutuman Ltd was a sub-lessee under which the second defendant Joinland Ltd was an agent and contractor.
