Court orders that Amban be reinstated

A COURT has ordered that Joseph Nop Amban be reinstated as deputy provincial administrator for Jiwaka and be reimbursed all salaries, entitlements and emoluments from May, 2013.
National Court judge Justice Nicholas Miviri said the matter had been “unnecessarily dragged to court” because Amban had already been reinstated by the Public Services Commission on July 13, 2018, but the administration ignored that decision.
Justice Miviri ruled that if Amban’s position of deputy provincial administrator had already been occupied, then he should be given another one equivalent to his previous position.
He ordered that Amban be paid from May 13, 2013 when he was suspended to the date of the court trial on Oct 14, 2020.
Amban was suspended over allegations of negligence of duties, failing to properly interpret laws in relation to a no confidence motion and misuse of funds.
On Oct 8, 2015, Amban took the matter of his suspension to the PSC.
It ruled on July 13, 2018 that Amban be reinstated as deputy provincial administrator.
When it was not done, Amban took the matter to court on March 14, 2019.
Amban yesterday welcomed the court’s decision and thanked his lawyer Jenny Topo and his family for their support.
He acknowledged the support of some public servants in the province.

  • Enough on internal politics in Kurumul Office and reinstate Amban asap. It is a new province and the PEC must give a fair share of position to all Jiwakan public servants, regardless of gender, greed, and or geographical locations. Respect the court decision and let Mr. Amban resume his duty.
