Court rejects bid to stop effort to provide financial report

A COURT has refused an application by former Konebada Petroleum Park Authority (KPPA) chief executive officer Donald Valu for a ruling against a letter from Finance Secretary Dr Ken Ngangan requesting all of his financial reports.
Justice Les Gavara-Nanu, in the Waigani National Court yesterday, refused Valu’s application.
He upheld submissions from State lawyer Irene Mugugia from the Office of the Solicitor-General, that the application was done prematurely.
“There should have been a decision-making process before a review be filed,” Gavara-Nanu said.
The State had submitted that the plaintiff’s application lacked valid concerns because the matter was still proceeding, and that a letter dated Sept 12, 2018, was the subject of the proceeding.
The State also submitted that Valu had come too early to court because administrative measures regarding issues he brought to court were yet to be exhausted on the administrative level.
Justice Gavara-Nanu said there was a public body to deal with such cases and that was through that Public Money Management Regularisation Act (PMMRA).
