Court strikes out attempted murder case

A MAGISTRATE has struck out an attempted murder case yesterday against a person with special needs because police failed to give evidence.
“I will strike out this case,” Waigani Committal Court Magistrate Paul Puri Nii told the police prosecutor after they were unable to provide evidence to support the charge.
He also ordered that bail be refunded.
“I have removed your case, the state will refund your K500 bail,” Nii told Peter Takilin, 42, from Anditala village in Kompiam-Ambum, Enga who has partial use of his left arm and is normally wheel chair bound.
Police alleged that on Jan 10, at around 10pm, a drunk Takilin at a business’s residential compound in Gerehu, Port Moresby, attacked two other men.
Takilin allegedly punched Willie Mark who had been sitting with another man, Francis Mare, knocking him to the ground.
Mare intervened and asked Takilin why he attacked Mark, the accused told him to shut up and threatened to attack anyone else in the compound.
Talikin then went to his room and got a long bush knife and tried to attack Mare.
Bystanders fled to safety while Mare defended himself with an iron rod and was eventually able to disarm Takilin and told him to address whatever grievance he had with the company’s management.
The matter was reported and Takilin was arrested and charged with attempted murder under Section 304 (a) of the Criminal Code Act.
