A MAN accused of sexually touching a minor had his case struck out last Friday by the Committal Court in Waigani, Port Moresby.
Magistrate Cosmas Bidar said police had failed to complete investigations and serve the files to the accused in time.
Police alleged that on March 24 in Morata Two, Port Moresby, Emmanuel Paul, 24, of Nebilyer, Western Highlands province,  touched the private part of a victim.
But Bidar found that police had not completed their investigations into the case and failed to serve a file on the defendant within the required three-month period.
Police said they could not go on with the case as the required three-month period had lapsed.
The court ordered that charge the defendant be struck out and the defendant’s bail money be refunded.
