Former police commissioner to re-submit motion to court

FORMER police commissioner Gari Baki, pictured, has re-submitted his notice of motion for a judicial review of his sacking by the Government.
Baki’s lawyer Francis Kuvi said they were resubmitting their motion to argue that proper procedures were not followed to sack him. “We have withdrawn the original motion, on August 21, to seek further orders.
“And that’s why we have re-submitted our motion.”
Kuvi said he was not aware that the hearing (for the original motion) was before Justice Royale Thompson at the Waigani National Court on Thursday and did not attend it.
Derek Woods, from Ashurst Lawyers representing the State, told Thompson that Baki, through his lawyer, had re-submitted a notice of motion to seek leave to review his sacking, although, he had earlier asked the court to withdraw the notice on Aug 21.
Woods also told the court that Kuvi was not in court.
Thompson adjourned the case for the judicial review on Sept 18 at 2.30pm
On Aug 21 the Waigani National Court granted leave for Baki to withdraw a notice of motion he had filed seeking to stay his termination.
Justice Oagile Bethuel Dingake said the notice of motion had no use because Baki’s term in office had expired on Aug 8.
