High Court to hear petition against MP

THE Supreme Court has agreed to hear petitioner Pila Ninigi’s application for a leave to review the lower court’s decision which dismissed his election petition.

This followed a ruling by Justice Salatiel Lenalia, sitting as a one-man Supreme Court bench, to dismiss Imbonggu MP Francis Awesa’s argument on the issue of the service of the petition. 

Lawyer Jeffery Kennedy, representing Ninigi, submitted that Awesa did not comply with court directions to file and serve submissions within the required time. 

Kennedy said Lenalia had the powers under the Supreme Court rules to dismiss Awesa’s application on the issue of service and expedite the matter for hearing. 

Lenalia, after hearing submissions, dismissed Awesa’s application and set the matter down for tomorrow when Kennedy will move the application for leave to review. 

The Electoral Commission is a respondent in the matter.
