A COURT has struck out a dangerous driving causing death charge against a 24-year-old due to lack of evidence.
Bona Robert from Akua village, Gumine in Chimbu asked the court to strike out his case as he had attended all hearings but the police prosecution had not provided any evidence to support the charge since January.
“Can the court release me so that I can go back to China and continue my studies since there is no police evidence against my charges,” he said.
Waigani Committal Court magistrate Paul Puri Nii struck out the charge saying the accused’s rights had been impacted.
Police prosecutor Sgt Christian Iga told the court that no details were provided by the case informant.
“The informant cannot locate the witnesses and get their statement of facts as they might have left the nation’s capital,” he told the court.
Police alleged that at around 8.30pm on Jan 1, Robert was driving at high speed along the Hubert Murray Highway.
It was alleged that Robert was driving from Erima to 5-Mile roundabout in Port Moresby when he hit and killed a man who was crossing the road.
