Homeowner forgives suspects, withdraws case
THE Waigani Committal Court has discharged two men charged with breaking and entering, stealing and conspiracy after the complainant decided to forgive them and asked court to withdraw the case.
The complainant, Verave Magilo, wrote to the court to withdraw the matter as he decided to forgive Mathew Moa and Foggy John Peter, for breaking into his house and stealing K6,500 worth of items.
Police prosecutor Senior Const Peter Samghy told the court that Magilo decided to forgive because they were neighbours and he did not want to see them as enemies.
He said the arresting officer also agreed for the case to be withdrawn.
Magistrate Cosmas Bidar ordered that the information be withdrawn and the defendants be discharged.
“The court will accept the application made by prosecutor on behalf of the complainant to have the matter withdrawn,” Bidar said.
The alleged offence took place between 11pm and midnight on Dec 28 at June Valley in Tokorara, Port Moresby, when Magilo and his family were on holiday.
The defendants, along with Clyde Duka, who is still on the run, allegedly entered Magilo’s premises, removed the fly wire on the window of the house and went inside.
The items they allegedly took were: a computer set, three bicycles, three fans, a rice cooker, an electric kettle, a stove element, two long trousers, five blouses, some clothes, four T-shirts, two window curtains, a scanner, a rubber water hose, a power adaptor, two power extension cables, two knives, a wall clock, two flash drives, a power pack and four cups – all valued at K6,500.
