Judge: Police to serve warrants
The National – Thursday, July 7, 2011
A JUDGE has pointed out that it is the responsibility of the police to serve warrants issued by the courts.
National and Supreme Court judge Justice Nicholas Kirriwom said the court should not be worrying about the enforcement of the warrants because that’s someone else’s responsibility.
He said when a court issued a warrant for arrest or remand, it was the responsibility of the public prosecutor to ensure that the orders were passed on quickly to the police and Correctional Service authorities.
On another matter, the judge also advised lawyers to disclose all information in court when applying for bail for their clients.
He made the comment when lawyer Samson Tolo elected to withhold certain information in court regarding offences his client was charged with.
Tolo from Jerewai Lawyers was successful in obtaining bail for his client but not after being reprimanded by the judge.
Tolo said outside court he had not tried to hide information because the files containing all the facts of the case had not been given to him by the lawyer who was previously handling it.
