Kaiwi trying to set aside murder info

BHOSIP Kaiwi, who allegedly tortured his wife Jenelyn Kennedy to death in June 2020, has filed a notice of motion to set aside the information of the charge of murder against him.
Kaiwi, through his lawyer Emmanuel Ellison, raised this in the National Court at Waigani yesterday after acting Judge Laura Wawun-Kuvi read the charge to Kaiwi to take his plea.
Ellison asked the court for time to obtain a transcript from the Supreme Court to support his notice of motion.
State lawyer Elizabeth Kave argued that the State was prepared to start the trial yesterday and the State’s witnesses were present in court.
Wawun-Kuvi told Ellison that the matter had returned to court yesterday for trial.
She also noted that the matter had been listed for a while which was ample time for any notice of motion to be filed.
Ellison said the accused had the right to a fair trial.
Wawun-Kuvi fixed today (Wednesday) for the matter to return to hear the notice of motion.
Kaiwi was then remanded to Bomana prison.
He was alleged to have assaulted his wife Kennedy, over a five-day period (June 18-22, 2020) at their Korobosea home in Port Moresby.
On June 22, Kaiwi allegedly brought a nurse home to treat Kennedy.
On June 23, Kennedy was taken to the emergency ward at the Port Moresby General Hospital but died as a result of internal injuries sustained from the alleged serious assault.
Kaiwi, from South Waghi’s Minj village in Jiwaka, was initially charged with wilful murder.
However during the committal process, the charge of wilful murder was withdrawn on Dec 1, 2020, as it was determined that there had been no intention to kill.
Kaiwi, however, was not discharged from custody.
Also on Dec 1, 2020, a murder charge was filed and granted.
Last March, a district court found enough evidence against Kaiwi for the murder charge.
