Lawyer files election loss petition for loss

A LAWYER who contested but lost the Gazelle open seat, in East New Britain, has filed an election petition in the Court of Disputed Returns.
A date for the hearing is yet to be fixed but the petitioner, Norbert Kubak, is asking the court to order immediate recount of all ballot papers for the Gazelle open electorate.
Kubak is seeking an order from the court to declare the election of Malakai Tabar as null and void.
“For the Gazelle open, there was no transparency in the counting process,” Kubak said.
“As a leader, I make it my business to ensure that the counting process is reflective of a truly democratic election process,” he said.
Kubak has named Electoral Commissioner Andrew Trawen as the first respondent, returning officer Ekonia Walom as the second respondent, the Electoral Commission as the third respondent and Tabar as the fourth respondent.
Chief Justice Sir Salamo Injia has appointed Justice Collin Makail as the judge administrator for election petitions and he will set dates and allocate judges to hear cases.
