Lawyer raises concern over multiplicity

A LAWYER has raised an issue of multiplicity of proceedings in court against his client, stating that it was an abuse of the process.
Frederick Lunge, of Ninerah Lawyers, representing Carlo D’Attanasio, facing criminal charges for his alleged involvement in a K200 million cocaine bust in July, told Central Committal Court Magistrate Laura Kuvi that it would be proper for police to decide on one charge for his client instead of three.
“I have raised the issue of the multiplicity of proceedings” he said.
“According to law, the charges should not be brought about in a way that it is too harsh on the person.”
Lunge said police should exercise their discretion of laying charges against the accused persons diligently.
In the case against D’Attanasio, he said, he was charged with three charges of which two had been removed by the court.
“Police should decide which is the appropriate charge to bring against the accused and the prosecution of that charge,” Lunge said.
Police Prosecutor Insp Boas Pinuali told the Court that police had only one charge against D’Attanasio which was before the court.
