HAVING sex with or without consent is immaterial, what matters is the age of the victim, a magistrate told a man accused of defilement.
Waigani Committal Court Magistrate Cosmas Bidar made the statement when committing to trial in the National Court the 23-year-old-man charged with having sex with an underaged girl.
Magistrate Bidar said there was sufficient evidence found against Arnold Peter, of Nabak in Morobe and ordered that he appear on June 22 for listing.
“I have found that there is sufficient evidence to commit your case to the National Court,” Magistrate Bidar.
“And it (National Court) will go through the evidences and tell you whether you have broken the law or not.”
Magistrate Bidar asked him if he had anything say in relation to section 96 of the District Court regulations but Peter declined.
According to police evidence, Peter was allegedly seen drinking with the girl’s brothers at around 1pm at Gerehu Stage 5 last Aug 18.
He then went to a nearby tuck shop to buy more beer.
Later that night, at around 1am, he called the girl to drink with him, which she agreed to.
When she was drunk, he had sex with her.
The girl, from a mixed background of Western Highlands, East Sepik and Central, was 14 years old at the time.
She reported the matter to her father and a complaint was laid at Gerehu Police Station where Peter was arrested and charged with sexual penetration of a child under the age of 16.

  • Why is the girl at the first place willing agreed to drink with the accused if she is underage. I think underage children are not allowed to consume alcohol, maybe it’s not her first time, to drink alcohol or having sex. In PNG settlements, trust me girls at that age know already what sex is, alcohol, smoking and so forth.

  • She is an out of sort 14 year old teenager with no strict measures, guidelines or discipline put forth by her parents to protect her.
    A 14 year old girl drinking speaks volume of who she is and her character reveals her true Identity.
    Parents take good care of your own kids because there are wolves who are out there to prey on the innocent.

  • She already knew what will happen to her when under the influence of alcohol so she accept the offer,let her deserve it and why she brought the matter to the court??????if she is underage then alcohol forbidden and not supposed to stay till late night around 12-1 o’clock????

  • Children under age of 14 are starting to have access to internet, phonographic and they are doing it at primary school. I witness, primary school children, grade 7 and 8 are congregating to have beer and drug, practicing cult just to having sex. some of this girls get raped while in that processes.

    Many children should be disciplined through Juvenile. Awareness needs to be carried out to improve.

  • That such a silly. The girl is doing the wrong thing at the wrong time and age 14 is a matter as well. Where is the parents or guardians too? Where is the drunken brother. That is such careless of life. At last the rapist get the privileged because all these measures are not there. After all the girls should be respected regardless of any thing.

  • Girl came from undisciplined parents. At 14 years of age, she already knows what is sex, beer, smoking and etc. Just because she was found and guilty of having sex, she had to report the case. She should also be charged for underage drinking and having sex knowingly that she is underage.

  • So the girl reported the matter to her father?????? Mmmmm, where was the father or mother at the time of the incident? Why did they allow their daughterto participate in this unlawful activity at such time into the night?

  • I have daughters too and am dumbfounded, parents should also be held accountable. Who in their right mind would allow such to occur and especially our daughters.
    First underage drinking, secondly bad parenting and bad choice of judgement to join in drinking which lead to the incident.
    So the perpetrator deserves to be locked up, the parent should also be locked up for negligence and the victim also should be penalized for being stupid.

  • First and fore most why was the parents not looking for her when she went outdrinking, with the accused? Why report the case when you parents had failed your part as parents of the child. Both parents should be arrested too for failing there duty as parents

  • Well, under the law it is an offence but the question is she knew she is 14 and why she went drinking with the man at such time as 1am? Where are the parents at that time? Do the parents have some rules at home? Can the parents be charged for negligence under whatever law that is available? Also is there any law to reprimand that girl for her part to allow herself to be drinking with the man at that time? Something must be done

  • Parents nowadays need to be fully committed to their responsibility as parents. monitor and control their children despite and regardless, especially the girls.

  • The question is this where are the parent’s ??, why she accepted the offer to have alcohol ??, she known”s she was under age 14. I think she deserved so why ? puting it to court .   • let the court decide on that, for the matter is before the court now. the guy is innocent until proven guilty in a court of law. check the girl’s virginity, my point is, if she hadn’t lost her virginity then that is a question the court will decide on the answer. get her to produce a medical report to prove her virginity, otherwise she could be another spoiled child in her community.
