Murder case dismissed due to incomplete report
A MAN charged with killing a woman had his case dismissed by the Waigani Committal Court because the police investigation report was incomplete.
David Jerry Gita, 24, from Jairapu village in Goilala, Cental, was a resident of 12-mile settlement outside Port Moresby when he allegedly committed the offence on Feb 24.
Magistrate Marcus Nandape discharged David Jerry Gita yesterday. He was charged with killing Babra Michael.
Defence lawyer Agnes Peter, from the Public Solicitor’s Office, told the court that Gita was kept in custody for more than six months which was a breach of his constitutional rights.
Magistrate Nandape said the last adjournment for the case was in June.
It was alleged that on Feb 23 Michael went to Kina Kon Whitehouse, a tavern, with her friends to dance.
She drank and danced with friends.
Between 12am and 1am Gita appeared and allegedly asked one of Michael’s sisters of her whereabouts. The sister told Gita she had not seen Michael. The dance continued until daybreak.
At about 6am, Gita was seen standing with Michael at a location from where she allegedly went missing. She was found dead at the Kina Kon Rice Farm at 12-Mile along Sogeri Road the next day.
