LAST week Bougainville and PNG leaders agreed to change the name of the Joint Supervisory Body (JSB) to Joint Consultative Body (JCB).
The body known as JSB is currently used in the Bougainville Peace Agreement, the PNG constitution and the Bougainville constitution.
JSB is responsible for overseeing the implementation of the transfer of powers to Bougainville, preparing draft legislations to give effect to the autonomy arrangements, and more importantly to solve any disputes between the two parties.
With the name JSB being replaced by another (JCB), one wonders whether the constitutions of PNG and Bougainville shall be amended to cater for the new body.
Surely the body known as JCB cannot perform the functions of the JSB because the functions of the JSB are specifically provided under the specific laws mentioned.
Unless there is an amendment to the constitution of both PNG and Bougainville, then the new body JCB can begin to carry out its new refined roles and responsibilities.
One wonders whether last week’s JSB meeting was properly advised by their respective legal officers of these legal implications.
