NEC has made a mockery of itself

The National, Friday 18th November 2011

THE National Executive Council’s decision to rescind its decision to suspend Chief Justice Sir Salamo Injia has turned it into a laughing stock.
Firstly, why the rush in making a silly decision in the first place?
There is a bunch of learned lawyers in the cabinet besides pre-eminent leaders such as Sir Mekere Morauta, Bart Philemon and Sir Puka Temu among others.
Our leaders have now lost their integrity and pride besides having their ego pricked.
Why did they mock their own intelligence for the sake of this half-baked decision?
Secondly, why was this decision rushed to the Government House to be signed by Governor-General Sir Michael Ogio?
It was then rushed to the Government Printing Office for gazettal.
Many of us have reasonably concluded that this was a repeat of Aug 2.
The manner and speed of events had left us shaking our heads.
This was a serious breach of the Constitution and norm.
The point of concern now is the office of the head of state.
This office is a creature of the Constitution and, as such, the governor-general ought to have performed the duties of this office with greater care.
This office is not a “rubber-stamp” for the NEC.
It is not legally obliged to accept any document from the NEC.
It is supposed to vet and screen the legality and constitutionality of the documents coming before it.
The PNG Law Society president, Kerega Kua, is correct to say the office of the head of state needed to have qualified lawyers to ensure all NEC decisions are screened, vetted and cleared for the signature of the governor-general.
The contentious issue is that of the governor-general.
The events of Aug 2 and the chief justice saga point to the conclusion that politicians should never ever be appointed as governor-general.
It is compromising the office of the head of state.
Finally, the NEC’s decision to sack the chief justice only to have it rescinded is tantamount to making a mockery of the law.
The governor-general is also a laughing stock for he had brought the office of the head of state to disrepute.
Please stop this practice.
