Opposition leader to refile application questioning legality of PM’s election

OPPOSITION Leader Belden Namah says he will be refilling his special application which the Supreme Court dismissed on Friday.
Namah told the media that he would be instructing his lawyers, Greg Sheppard and Philip Tabuchi, to refile the application using the correct word “application”.
“I want to assure the people of Papua New Guinea that I am not done,” Namah said.
“I will sit down with my lawyers to consider the next cause of action.”
Namah’s special application questioning the legality of Prime Minister James Marape’s election was dismissed on technical grounds by the Supreme Court.
The court ruled that Namah’s application was not in compliance to Order 4, Rule 1 and form 1 of the Supreme Court rules.
Namah wrongly named the file reference as a “reference” instead of “application”.
Adhering to strict compliance to Supreme Court rules necessary in applications trying to overturn the will of a parliament, the
court found Namah’s entire application defective on technical grounds.
