Police reject application to drop rape, incest case

POLICE have refused an application to withdraw the case of a 37-year-old man who is charged with raping his sister in Port Moresby in December.
Magistrate Danny Wakikura on Wednesday told the accused that the application should come from the police through the sister.
Police prosecutor objected the application because police file was already served on the accused.
Wakikura told the accused that he was in court to defend himself and not making applications to withdraw the case.
He then adjourned the matter to June 1 for submission on sufficiency of police evidence and extended the accused’s K1,000 bail.
On Dec 4, at about 11am the accused and his sister were at home when they started drinking alcohol.
The accused drank a mixture of alcohol and homebrew which he brewed himself and the sister drank six cans of beer and blue berry until morning on the veranda of their family house.
Between midnight and 2am, while the sister was asleep, the accused allegedly removed his and his sister’s clothes and raped her.
Their father looked through the window and saw his son allegedly raping his sister.
The father quickly kicked the door and the accused opened the locked door.
On Dec 7, the sister and her father lodged a police report.
The accused is charged with one count of rape and incest.
“Rape and incest is a serious crime,” he added.
