A JUDGE has warned prison authorities to treat everyone in their custody fairly as they are entitled to the full protection of the law.
Justice Panuel Mogish sounded the warning to Bomana prison authorities in court yesterday after a prisoner had complained of being assaulted by warders.
“I make this statement in the context of the earlier case I heard for defendant Glen Tobewa where the allegation of assault on prisoners has being raised,” he said.
“A 30-year-old man charged with a count each of robbery and unlawful use of a motor vehicle stated in his affidavit that he had been assaulted by CS officers every time he returns from his court hearings in Waigani.
“He has been in prison since September 2018 – a total of one year and 10 month.
“Everybody who comes into the custody of Correctional Service must be accorded a fair treatment.
“They are entitled to the full protection of the law.
“So I just like to stress this point at this point in time.”
On the case of Bosip Kaiwi facing a wilful murder charge and had complained of being assaulted, Justice Mogish said he would be moved to the main prison compound when his 14-day quarantine ended.
He was remanded at Bomana on Wednesday, June 24.
“You will have to follow processes in Bomana. How you will be dealt with here at Bomana is something for the Bomana jail commander to look into.”
“I have no jurisdiction over that.”
