Prosecution files to have suspect’s bail revoked

A MAN allegedly charged with raping his sister-in-law was alleged to have breached one of his bail conditions with the prosecution making an application for his bail to be revoked.
Police prosecutor Constable Shellian Pius made the application after receiving information from the state’s witnesses that the accused had been interfering with them, thus breaching a condition of his K1,000 bail.
Pius submitted evidence of the accused emailing, sending text messages and posting on social media (Facebook) offering money (K10,000 each) to the 19-year-old victim and her siblings to settle the matter out of court.
She asked the court to have the accused’s bail revoked, bail money set aside and he be remanded for breaching the bail conditions.
Waigani Committal Court Magistrate Tracy Ganaii said she would go through the files and make a ruling on the application for revocation on Friday.
The accused, a 37-year-old from Magarima in Hela, was charged with one count of sexual penetration.
The alleged incident happened at Vadavada in Port Moresby on Nov 5 last year at around 7.30am.
The court heard that he entered the victim’s room and forced himself on her.
He allegedly gave her K250 and told her not to tell anyone about the incident and that he would give her money later.
The offence was committed when accused’s wife was out of the contry.
The matter was reported to CID-SOS Boroko police station where the accused was formally arrested and charged with rape under Section 347 of the Criminal Code Act.
The substantive matter returns on March 6 with his bail extended.
