Solomon to stay in office

ANNA Solomon will continue in her position as acting Community Development Department secretary because the man she replaced had been removed by Cabinet, it has been revealed.
In a statement yesterday, Solomon responded to a National Court decision last Friday to reinstate Joseph Klapat as the department secretary after Cabinet removed him on December 29, 2011.
Solomon said the judicial review Klapat sought was based on that Cabinet decision 26 months ago.
But she said Cabinet had sacked Klapat on March 5 this year and appointed her acting secretary.
“The court’s decision to reinstate Klapat was for the NEC decision on December 29, 2011,” she said.
“However events have overtaken the judicial review sought by Klapat.
He was terminated on March 5, gazetted on March 12, 2014.”
She said Klapat’s sacking, according to the Gazette, was a new event which Klapat would have to challenge again in court if he wanted to.
Justice Colin Makail ruled last Friday that Klapat’s suspension did not follow procedures prescribed in the constitution, the Public Service Management Act and the clauses in his contract of employment.
The National Gazette, authorised by Governor-General Sir Michael Ogio, said evidence against Klapat before the Public
Service Commission and the Department of Personnel Management “shows the existence of misappropriation in the department thus warranting revocation of appointment”.
