Suspended officer’s case adjourned
The National, Friday July 25th, 2014
THE court case of suspended Assistant Commissioner of Police Simon Kauba has been adjourned for two weeks.
Justice Les Gavara-Nanu allowed the adjournment to give time for counsel representing defendants, National Executive Council and the State, to prepare.
Kauba filed judicial review proceedings in the Waigani National Court challenging his suspension by NEC.
He filed an application seeking to stay the NEC decision to suspend him pending the determination of the judicial review proceedings.
On Tuesday, Kauba’s lawyer, Wesley Bigy appeared in court stating he was ready to proceed with his leave application for judicial review and a stay application.
State lawyers advised the court on Tuesday that they needed an adjournment as they were awaiting confirmation from Attorney-General Ano Pala as the matter was briefed out to a private law firm.
But yesterday lawyer Nicholas Tame representing NEC and the State said he was not ready to proceed. Bigy agreed with Tame on the matter to be adjourned to Aug 7.
