A SENIOR teacher in Southern Highlands, who challenged a decision by the provincial education board (PEB) to remove her as principal of a school, has been granted leave by the National Court in Mt Hagen for a judicial review.
Jennifer Peter was initially appointed by the Teaching Service Commission (TSC) to be the principal of Yebi High School for three years from 2019.
But her appointment was revoked by the provincial education board which then appointed Max Tumbe.
Peter was subsequently appointed by the PEB as deputy principal for Kagua Secondary School.
Peter’s lawyer Danny Gonol told the court, presided by Justice Kenneth Frank, that the decision was a relief for his client who wanted her rights protected.
He submitted that the Southern Highlands PEB had no powers to deal with teachers on tenure appointments which was the responsibility of the TSC.
Justice Frank’s interim orders were for Peter to be reinstated with all privileges and responsibilities by Oct 9 in compliance with the TSC decision while the PEB and its agents were not to interfere with the plaintiff in the carriage of her duties.
Gonol said they would take legal action against the defendant if the orders were not executed.
