Trio acquitted of theft

Three men charged with armed robbery have been acquitted by the Waigani National Court in Port Moresby yesterday.
Justice Daniel Liosi acquitted Anasi Apak from Eastern Highlands, Robin Badui Jnr from East Sepik, and Kimugo Komafe, from Eastern Highlands, after the court found inconsistencies in
the testimony of the State witness.
The court heard that on Aug 24, 2015, the complainant, Erwin Sunga, was with his family at their house when the incident took place.
The court heard that five or six men jumped over the fence into the complainant’s residence and held up his family and him at gunpoint.
The men stole K213,000 in cash from the complainant’s wife and a pistol registered under his name.
Justice Liosi said that the State relied heavily on one witness and the court did not accept the evidence of the witness because he mentioned two names but could not connect names to the three offenders.
He also said the witness also mentioned one accused but did not mention the
other two who were also charged.
Justice Liosi ordered the trio to be acquitted because he was not satisfied with
the evidence presented in court.
