Yama remains governor of Madang, petition dismissed

PETER Yama remains the Governor of Madang after the Supreme Court yesterday dismissed as an abuse of process an election petition filed by Jerry Singirok.
Chief Justice Sir Gibbs Salika, when delivering the five-men bench’s decision, said the oral objection to the competency of the application for review was dismissed.
The bench consisted of Sir Gibbs, Justice Ellenas Batari, Justice Panuel Mogish, Justice David Cannings and Justice Thomas Anis.
“The application for review is granted, the order of the National Court of March 1, 2018, in election petition No. 69 of 2018 is quashed,” Sir Gibbs said of the events that led to Yama defending his election win.
“It is declared that Yama was and shall be for all purposes regarded as the successful candidate in the election and subject to this proceedings.”
The National Court in 2018 upheld the petition finding that James Yali, who came second in the election, was disqualified and that his presence to the count up to the final elimination may have affected the order in which other unsuccessful candidates were eliminated and may have allowed other candidates to benefit from his preference votes.
Yama, aggrieved by the decision of the National Court and having been granted leave, applied to the Supreme Court for review, claiming that it was erred in law by not requiring Singirok to plead and prove the error of the Electoral Commission in accepting the disqualified candidate’s nomination.
That affected the result of the election and the National Court decided to declare the election void.

    • God will do a fair judgement on the case in due course. If Yama won by bribery, he knows it himself and nobody can change that fact.
