Yamuna’s suspension stopped

CLIMATE Change and Development Authority managing director Ruel Yamuna will resume duties after the National Court granted him an interim stay his lawyer had sought over his suspension.
Justice Nicholas Miviri on Friday stayed the decision by Environment, Conservation and Climate Change Minister Wera Mori who suspended Yamuna on allegations of misconduct and misappropriation.
Justice Miviri found that there is a very strong arguable case posed in respect of the suspension that was effected, thus, a judicial review of the decision is afoot.
He stated that the allegations set out against Yamuna by a letter from Mori were very serious.
However, it was more to ensure that proper procedures by law were followed to ensure what was alleged materialised at the end.
He explained that the functions discharged materially that underpinned the running of the authority was found on Section 46 of the Climate (Management) Act 2015.
“No man is above the law, all are susceptible to the realms of the law” Justice Miviri said.
“And it should not be the case that a bar is erected against the path of law and its rule.”
The judge emphasised that there was no process of criminal law against Yamuna and that his contract life would end in two months from now, which would be proper to allow it to continue because he was still getting paid and ought to earn his keep, so to speak.
Yamuna said that he was looking forward to resuming duties (today) to restore confidence in the staff and general administrative duties.
He said the allegations levelled against him were legacy issues created by past management.
The matter will return on March 1 for directions hearing.
