Charge dismissed due to delayed police file

A COURT has dismissed a charge of causing death by dangerous driving against a 40-year-old man because police were slow in producing their file in court.
Lae Committal Court Magistrate Pious Tapil ordered that Ben Torea of Alimbu village in Pangia, Southern Highlands be refunded his K2,400 bail money.
He also told Torea to be on good behaviour.
“You won’t be seeing any mercy from the court if you appear in court again,” Tapil said.
“Consider this as a warning and mercy from the court and behave while being outside.”
Police alleged that on Feb 5, at 11-Mile in Lae, Morobe, Torea was driving a truck owned by a company towards Nadzab when he allegedly hit Roselyn Serembi who was crossing the road.
The court heard that Serembi was thrown into the air and landed some meters away.
Police believe that Torea was driving at high speed.
The court was told that she was taken to the Angau Memorial General Hospital but she did not make it.
