Court dismisses theft and property destruction charges

A MAGISTRATE dismissed a break-and-enter and stealing charge against a 39-year-old man for lack of police evidence.
Koae Manu, from Babiko village, Kairuku in Central, was also charged with intent to commit a crime and arson.
Magistrate Hilda David Aipi at the District Court in Waigani, said the prosecution had failed to provide evidence within a reasonable amount time and she had to dismiss the case.
Police prosecutor George Vetari requested leave to consult the informant, however, Magistrate Aipi refused leave and dismissed the case for want of prosecution.
Vetari did not object to ruling.
Kim Watakapura, from the Office of Public Solicitors representing Manu said Manu had been faithfully attending court but the prosecution had failed to provide any evidence before the court.
It was alleged that last Sept 26, Manu and six other accomplices armed with bush knives, hammers and iron bars had gone to John Parau’s (complaint) house, broke in and ransacked it and took all items of value.
Other property such as a water tank and a vehicle parked near the house were burnt and destroyed. Police alleged that Manu and the others had acted in retaliation after Parau’s son had allegedly killed his son.
