A DISTRICT Court has set tomorrow for the hearing of an application for an Englishman charged with possession of methamphetamine and its implements.
District Court Magistrate Albert Daniels yesterday told Wayne David Rooke, 39, from the Midlands in England, that his lawyer had to make submissions for the application questioning a provision of the Controlled Substance Act on jurisdictions by tomorrow.
“I have set Wednesday for the hearing of submissions on the application so a ruling can be handed down next Monday (May 28),” he said.
Rooke’s lawyer Fredrick Lunge informed the court that he would make submissions for the application tomorrow.
Police Prosecutor Sgt Gibol Mol told the court that prosecution had no issue with the adjournment of the submission hearing.
Police alleged that on Sept 14 between 11am and noon, Rooke was at a house at East Boroko in the National Capital District.
It was alleged that police had received information that Rooke was there after several calls made for him to report to a nearest police station but he kept on resisting.
Police went to the location and reasonable force was used on Rooke and he was restrained and arrested.
He was then taken into his bedroom to witness a police search.
Upon entering his bedroom, police allegedly found two grams of methamphetamine and its implements.
He was then charged and detailed at Boroko holding cells.
