ICCC revokes proposed deal with airlines

The Independent Consumer and Competition Commission (ICCC) says it has revoked its authorisation granted to Link PNG Ltd (Link PNG) to give effect to the proposed codeshare arrangement with PNG Air Limited (PNG Air) last October.
ICCC in a statement yesterday said the proposed codeshare arrangement was both passenger and freight services and particularly for the domestic routes.
ICCC acting chief executive officer Brian Ivosa said: “The authorisation stipulated clearly what Link PNG needed to do in terms of complying with the preliminary conditions in order for the authorisation to be effective.
“However, Link PNG failed to comply with a preliminary condition which has triggered this revocation.”
Section 80(1)(c) of the ICCC Act stated that “If at any time after the commission has granted an authorisation under Section 70, the commission is satisfied that – a condition upon which the authorisation was granted has not been complied with, the commission may revoke or amend the authorisation or revoke the authorisation and grant a further authorisation in substitution for it.”
Ivosa said: “Condition of the authorisation required the parties to submit the revised and signed code-share agreement to the ICCC within three months from the date of the release of the determination.
The ICCC released its decision last Oct 29, and the three-month period lapsed on Jan 29.
