Inquiry into sale, purchase of Motukea Wharf to start

THE Commission of Inquiry into the sale and purchase of the Motukea Wharf is expected to start next week, an official says.
Commission of Inquiry chairman Sike Julian Toulik said there was a clear statement on the case and terms of reference for the inquiry.
A report will be submitted to Prime Minister James Marape at the conclusion of the inquiry.
The inquiry is to establish whether there were breaches of laws and constitutional requirements during the negotiation and approval on the relocation of the Port Moresby wharf and acquisition of Motukea wharf.
It will also establish whether PNG had suffered losses as a result of this deal and whether persons involved could be held accountable for their actions.
It will find out:

  • WHEN the decision was made to relocate the Port Moresby wharf to Motukea;
  • WHO made the decision to relocate the wharf;
  • WHAT was the rationale behind the relocation of the wharf;
  • WHAT were the terms and conditions of the decision to relocate the wharf;
  • WHETHER proper legal and administrative processes were followed in the sale and purchase of the Motukea wharf, including but not limited to, how the process commenced, what process was used, who was involved, who was the financiers(s) of the entire transaction, what were the terms and conditions of the entire transaction and what was the value of the whole transection;
  • WHAT process was used in the past to obtain finance to transaction similar in nature; and,
  • RECOMMENDATIONS for the prosecution of any illegal activities, including but not limited to the recovery of money lost through any illegal, criminal or negligent conduct in the entire transaction.

The commission will run for six months.
