Kaiwi’s case adjourned

THE case of Bhosip Kaiwi charged with killing his partner Jenelyn Kennedy last year was further adjourned to March 23 by presiding Magistrate Tracy Ganaii.
Magistrate Ganaii in the Waigani Committal Court yesterday, said she needed more time to look at the submissions to make a ruling.
Submissions on Kaiwi’s case were made on March 2 by his lawyer Mathew Wenge and Police prosecutor Sgt Joseph Sangam.
Kaiwi, 25, of Minj village, South Waghi, Jiwaka, was then remanded.
Wenge during submissions made an application for the matter to be struck out on the basis that;

  • THE manner in which witness statements, documents, exhibits were obtained did not meet the requirements of admissibility under section 94C (ii) of the District Courts Act (DCA);
  • DEFENCE objected to the authenticity of the affidavit by the arresting officer Yapu Gwampom, who filed an affidavit explaining how statements were obtained;
  • THERE is insufficient evidence in the police hand-up brief to prove the elements of murder;
  • DEFENCE submitted that Snr Const Gwampom made a general statement on how the witness statements were obtained and;
  • WHEN the charge of murder was brought in, there was no existing proceedings for substitution.
